SMSF consultant faces criminal charges

A Sydney-based SMSF consultant has faced court over charges linked to $250,000 of clients' money.

A self-managed superannuation fund (SMSF) consultant faced Downing Centre Local Court yesterday on three criminal charges, including obtaining around $250,000 by deception.

Sydney-based Craig Gerard Dangar appeared in court on two counts of obtaining money by deception and one count of making a false or misleading statement in a document lodged with ASIC.

The charges follow an ASIC investigation into Dangar's conduct while he was employed by SMSF Consultants (SMSF), an accounting practice located in Sutherland, in Sydney's south.

Dangar provided technical superannuation advice to trustees of SMSFs as well as compliance advice to other accounting firms, ASIC said in a statement. 

He was employed by SMSF Consultants between January 2004 and September 2007.

"ASIC alleges Mr Dangar falsely claimed, in a document lodged with ASIC, that he was a director of SMSF in order to obtain a loan he required to purchase shares in Morris Finance Ltd. This document represented that Mr Dangar had the authority to take a charge out against SMSF," ASIC said. 

"ASIC also alleges that Mr Dangar gained a financial advantage of approximately $250,000 when recommending clients purchase shares in Morris that he owned by misrepresenting the true value of the shares."

Dangar was granted conditional bail.

The matter is due to return to Downing Centre Local Court on 20 March.
