Kenyon Prendeville wins battle against competitor

Radar Results has been ordered to stop using the domain name kenyonprendeville.com.

Financial Planning broker firm Kenyon Prendeville has secured the transfer of the domain name kenyonprendeville.com from an industry competitor, InvestorDaily has learned.

After becoming aware that the domain name had been registered by buyer advocate Radar Results and was being used to redirect internet traffic to Radar Results' website, Kenyon Prendeville said it filed a domain name complaint with the World Intellectual Property Organisation (WIPO).

According to documents obtained by InvestorDaily, WIPO panellist James Barker found Radar Results had no legitimate rights to the domain name.

Barker also found it was overwhelmingly likely that Radar Results knew of Kenyon Prendeville's reputation in the industry as the companies were in competition in the same jurisdiction, and that the domain name was registered and used in bad faith by Radar Results.

As a result, Barker ordered AustDomains International, the current domain name registrar, to transfer the domain name to Kenyon Prendeville.

When contacted, Radar Results said it was not sure what action it would take next, but confirmed that the transfer of the domain name was not something it could appeal.
